US Judge Orders Release of Kilmar Abrego Garcia from ICE Detention
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment lacks legal authority.
"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The situation stems from a erroneous removal to El Salvador in March, which US authorities later admitted was an mistake. After his return to the United States to answer alien smuggling allegations, he was held in immigration custody.
In her order, the judge pointed out that the government lacks a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
Background of the Legal Challenge
The court proceedings involve conflicting claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.
He has also pleaded not guilty to the smuggling charges, which are part of a ongoing trial in the state of Tennessee.
Terms of Freedom
The judge, who was overseeing his petition to deportation in a Maryland district court, determined that he must now comply with the terms of his bond from jail in Tennessee. This order shifts his supervision to the Tennessee court.
This decision represents a notable turn in a complicated immigration battle involving allegations of mistaken imprisonment and disputed criminal associations.
